The ICR cannot review statutory decisions taken by the Charity Commission. If you have concerns about a decision and wish to challenge it, the Charity Commission has a Decision Review process, which might be applicable to your case. You may also be able to appeal to the Charity Tribunal.

The Charity Tribunal was established by the Charities Act 2006 and was transferred to the First-Tier Tribunal (Charity) on 1st September 2009 following reforms of the Tribunal system by the Tribunals Courts and Enforcement Act 2007. The First–tier Tribunal (Charity) is administered by the Tribunals Service, an executive agency of the Ministry of Justice. The Principal Judge of The First–tier Tribunal (Charity) is Alison McKenna.

You can contact the First–tier Tribunal (Charity) direct and ask for information about making an appeal against a Charity Commission decision. There is an appeal form which can be downloaded from the Tribunal’s website or you can ask the Tribunal office to send a form to you by post. The First–tier Tribunal (Charity) Explanatory Leaflet

If you wish to appeal to the First–tier Tribunal (Charity) you must do so in writing within 42 days of the date on which the Charity Commission sent you the notice of decision or within 42 days of the decision being published on the Charity Commission's website. If you are making an appeal outside of the time limit you must include reasons for the delay in the Notice of Appeal Form.
